This privacy policy explains what data we collect, how we use and protect it, and what rights you have when using imusau.lt.

We process personal data under the General Data Protection Regulation (EU) 2016/679 (GDPR), the law of the Republic of Lithuania and other applicable data protection requirements.

1. GENERAL PROVISIONS

1.1. This privacy policy applies to the website www.imusau.lt, the Imu Sau mobile apps (Android and iOS) and the social media accounts we manage, where we process your personal data.

1.2. IMU SAU is a free marketplace where users can list goods, buy, sell, swap, give away, offer prices and talk directly with each other.

2. WHAT DATA DO WE COLLECT?

2.1. When you register on Imu Sau we ask for a username, email address and password.

2.2. In your account you can also add your name, surname, profile photo, city, phone number and other information you choose to provide.

2.3. When you upload a listing you provide photos, titles, descriptions, prices and other information about the goods.

2.4. When you use messaging we also process sent and received messages, price offers, comments and reviews.

2.5. When you visit the website or use the app, technical data may be collected automatically: IP address, browser information, device type, login time, pages viewed and data about how you use the platform.

2.6. We may also receive data from other users when they submit complaints or report inappropriate behaviour or possible breaches of the terms.

3. WHY DO WE USE YOUR DATA?

4. USE OF PHOTOS, LISTINGS AND ORIGINAL WORKS

4.1. Imu Sau respects users’ copyright. Copyright in photos, descriptions and other original works created by the author remains with their lawful owner.

4.2. By uploading a listing and granting the non-exclusive, royalty-free right set out in the Imu Sau terms of use, the user allows the platform to use photos and descriptions from public listings.

4.3. That right allows Imu Sau to use listing photos and descriptions to:

4.4. We do not ask for a separate permission for each use of photos or descriptions for the stated advertising purposes. The user is treated as having already granted that right by registering on Imu Sau.

4.5. Imu Sau does not take over the user’s copyright in their works. The right granted is non-exclusive, so the user may continue to use their photos, publish them on other platforms and advertise their products.

4.6. The right applies to publicly published listing content and applies worldwide to the extent needed to display listings and advertise Imu Sau. It lasts while the listing is active.

4.7. After a listing and its photos are removed, Imu Sau does not use them in new promotional posts. If photos have already been published on social networks we manage, the user may ask for them to be removed by writing to info@imusau.lt.

4.8. Third-party liability for use of photos

4.8.1. Imu Sau does not sell photos uploaded by users to third parties and does not give them the right to use those photos independently.

4.8.2. If third parties, without the author’s permission, copy, save, distribute or otherwise use photos published on the Imu Sau platform or on its social media accounts, the persons who do so are responsible for those acts.

4.8.3. Imu Sau is not liable for unauthorised acts of third parties that the platform does not control, except where liability falls on it under the applicable law.

4.8.4. If you notice unlawful use of photos, you can report it to info@imusau.lt. We will review the report and, within our ability and legal duties, take appropriate action.

4.9. The user must have the right to use the photos they upload and to grant the right described in this section.

4.10. Photos or documents sent in private messages are not used in Imu Sau advertising under this right. Use of identifiable people’s images and other personal data in advertising is also subject to the rules on personal data and image protection.

5. DISCLOSURE OF PERSONAL DATA

5.1. Imu Sau respects users’ privacy and processes personal data in line with the applicable law. Personal data may be shared with providers of technical, analytics and advertising services only where there is a lawful basis and only as far as needed to provide those services. Imu Sau may also use photos and descriptions from public listings to advertise the platform, including on social networks, under the terms of use.

5.2. Public listings and the profile information a user chooses to make public may be visible to other visitors and to search engines.

5.3. We may also provide data to competent public authorities when the law requires it.

5.4. When data is transferred outside the European Economic Area, the safeguards required by the GDPR apply.

5.5. Buyers and sellers agree payment and delivery between themselves. Imu Sau does not intermediate their direct payments.

6. COOKIES AND ADVERTISING TECHNOLOGIES

6.1. Imu Sau uses cookies and similar technologies to keep the website working, remember your choices, analyse visits and show advertising.

6.2. The website uses Google advertising technologies and visit analytics. Depending on the integrations in use, data may also be processed through other advertising or analytics providers.

6.3. Essential cookies are used to keep the website working. Non-essential analytics and advertising cookies that require consent under the law are used only after you have given consent in advance.

7. HOW LONG DO WE KEEP DATA?

7.1. We keep personal data only for as long as needed for the purposes of processing or as required by applicable law.

7.2. Data of an active account is kept while you use the account. Listing data is kept while the listing is active, and private chat data is kept under the messaging retention rules that apply.

7.3. After an account is deleted, data is erased or anonymised according to the set retention periods, except where it must be kept for legal obligations, security or legitimate claims.

7.4. We provide further specific retention periods, or the criteria used to set them, according to the categories of data processed and the actual IMU SAU data retention practice.

8. HOW DO WE PROTECT YOUR DATA?

8.1. We aim to apply appropriate technical and organisational measures to protect personal data from unlawful access, loss, alteration or disclosure.

8.2. Access to non-public personal data is given only to authorised people, and only when needed for their duties.

8.3. Users must also keep their login details safe and not disclose passwords to other people.

8.4. The content of private chats is not made public. It may be accessed only in lawful and justified cases, for example when reviewing possible fraud or a security incident.

9. WHAT RIGHTS DO YOU HAVE?

10. DELETING AN ACCOUNT

10.1. A user may delete their own account or ask for the account to be deleted and personal data erased.

10.2. After the account and listings are removed, their photos are not used in new Imu Sau promotional posts.

10.3. Some data may be kept longer if that is needed to meet legal requirements, handle disputes or for other lawful reasons.

10.4. Messages already sent to other users may in some cases remain in their chat history where there is a lawful basis.

10.5. Removed public information may remain for some time in the caches of independent search engines or third parties.

11. CHANGES TO THE PRIVACY POLICY

11.1. Imu Sau may update or change this privacy policy when our services, technology or the applicable law change.

11.2. The latest version of the privacy policy is published at www.imusau.lt.

11.3. Users are informed of significant changes in an appropriate way. If a change needs new consent or a separate agreement, we ask for it as required by law.
